Noţiuni introductive privind încetarea contractului individual de muncă Through the conclusion of the Contract on Labour, reflected in article 43, of the Constitution of the Republic of Moldova of 1994 a citizen exercises the right to work. This right presumes not only to treat citizens of the Republic of Moldova in equal way in the field of juridical reports on labour but the assurance of the stability of juridical reports on labour, as well. -
Noţiuni întroductive privind încetarea contractului individual de muncă The article represents a tentative to study the individual labour contract and especially the aspects connected with the cessation of the latter in the light of the Constitution and of the Labout Code of the Republic of Moldova. The author pays special attention to the notions of dismissal and resignation and studies the causes that lead to the cancellation of the individual labour contract. At the same time, the practice of signing and canceling the individual labour contract in such countries as Romania, Austria, Switzerland, etc is described. The way the legislation in force in this field in the Republic of Moldova is being stated and dissected also presents interest. -
Unele reflecţii juridice privind modelarea deciziilor angajatorului în segmentul resurselor umane în vederea optimizării cheltuielilor pentru personalul angajat Dans Ies conditions de la recession et de ia stagnation economiques, beaucoup de a commeiQants sontforces de revoirleurs decisions degestion relatives au personnel employe 73 afin d'optimiser Ies couts d'entretien de celui-ci. Ainsi, selon Ies dispositions du Code du travail de la Republique de Moldavie, Ies employeurs peuvent utiliser Ies operations et Ies techniques juridiques suivantes: licenciement des employes r cause de la reduction du 47 personnel; reduction du montant des salaires de fonction ou de charge; application du regime de travail r temps pârtiei; suspension des contrats individuels de travail en cas de chomage technique; obligation des employes de rediger des demandes de conge sans remuneration. Beaucoup d 'employeurs considerent, r tort, que ces operations peuvent etre rialisees sans condition etsans prendre en compte les stipulations de la legislation du travail. Nous soulignons que toute decision prise dans ce cas devrait etre en stride conformite avec le Code du travail de la Republique de Moldavie et d 'autres actes normatifs dans le domaine. -
Unele reflecţii teoretice privind parteneriatul social în sfera muncii din Republica Moldova The social-political changes which occur in the Republic of Moldova may be successfully implemented in the event of social peace and some coordinated agreements between social partners which represent the interest of the employees, employers and the state. In order to provide an enhanced coordination of standpoints and to take into account the interests of the social partners, which largely seem to contradict each other, the world experience elaborated the social partnership system. This is a system which permits amicable settlement of disputes which arise between the social partners. In this article the author approaches and analyses some aspects pertaining to the social partnership in the area of labour by means of international instruments and the legislation of the Republic of Moldova. -

The new technologies have resulted in increased use of surveillance and monitoring and an increase in the tension between management rights and employee privacy. In this article, the authors examine the basic legal aspects of the procedure for the employee video monitoring. -
Unele reflecţii privind metoda de reglementare juridică a dreptului muncii This article reflects the aspects of the method of legal regulation of labor law which are complex and dynamic. To elucidate this issue, references to the author’s opinion towards this subject were made, and specific features and characteristics were found. In this context, were overlooked the specific characteristics of the method of legal regulation of labor law. As a conclusion to the subject, we appreciate that the method of legal regulation of labor law has a dichotomous nature in that it is divided in the method of coordination for collective relations and the method of ordering the individual employment relationship. -
Dreptul de negociere colectivă prin prisma instrumentelor internaţionale şi a legislaţiei naţionale a Republicii Moldova The right of workers to bargain collectively is a fundamental right, which is recognized in the Constitution of the International Labour Organisation (ILO) and the Declaration of Philadelphia annexed to the ILO Constitution. The legal protection of the right to collective bargaining is the key to the representation of collective interests. It builds on freedom of association and renders collective representation meaningful. Collective bargaining can play an important role in enhancing enterprise performance, managing change and building harmonious industrial relations. In this connection, the author of the given research paper has elucidated the legal institute of the collective bargaining according to the ILO Conventions and the labour legislation of Republic Moldova. -
Unele reflecţii juridice privind regimul legal al muncii de noapte în instrumentele internaţionale, în actele normative ale Uniunii Europene şi în reglementarea Codului Muncii al Republicii Moldova Night work has been a matter of serious concern for the international bodies, both at European Union and international levels. As evidence of such disquiet is the Convention of the International Labour Organization concerning Night Work no.171/1990 and the Directive 2003/88/EC of the European Parliament and of the Council of 4 November 2003 concerning certain aspects of the organization of working time. In this article, the authors highlight the concepts of “night work” and “night worker” through the national legislation and international instruments, and also analyse the compatibility of the national legislation pertaining to night work with the standards of the International Labour Organization and the directives of the European Union. -
Reflecții privind modificarea contractului individual de muncă The present article accomplishes a scientific practical study on the modification of individual contracts and highlights the most important subjects regarding the content/ matter of this theme.Initially, the subject is concerned with the notion of changing the individual labor contract. Its types and legal aspects, that are produced as a result,are highlighted. A distinct aspect is dedicated to the changing procedure of the individual labor contract by appealing to judicial practice.In order to understandbetter the matter,examples of legal acts, which can be used in practice, are attached. -
Consideraţii privind dreptul salariatului la respectul vieţii private la locul de muncă Toţi salariaţii au dreptul la demnitate în muncă. Astfel, în sensul Codului muncii al Republicii Moldova (în continuare – C.M. al R.M.), demnitatea în muncă este definită ca un climat psihoemoţional confortabil în raporturile de muncă ce exclude orice formă de comportament verbal sau nonverbal din partea angajatorului sau a altor salariaţi care poate aduce atingere integrităţii morale şi psihice a salariatului. Totodată, subliniem faptul că salariaţii sunt obligaţi să respecte dreptul la demnitate în muncă al celorlalţi salariaţi (art. 9, alin. (2), lit. d2) din C.M. al R.M.). -
Unele reflecţii juridice privind dreptul angajatorului de a-şi revoca ordinul de concediere a salariatului În literatura de specialitate a fost acreditată ideea revocabilităţii actelor juridice unilaterale ale angajatorului. În acest articol este elucidat regimul juridic al revocării de către angajator a ordinului (dispoziţiei, deciziei, hotărârii) de concediere a salariatului. În plus, au fost scoase în relief condiţiile ce trebuie îndeplinite cumulativ pentru a valida un asemenea act de revocare. În urma cercetărilor efectuate, autorii au ajuns la concluzia că angajatorul poate revoca ordinul (dispoziţia, decizia, hotărârea) de concediere a salariatului doar după obţinerea acordului prealabil în formă scrisă al fostului salariat, revocarea unilaterală neproducând efecte juridice.
