Consideraţii privind instruirea universitară şi postuniversitară în domeniul administraţiei publice, realizări şi tendinţe The problem of university and post -graduate studies in the field of public administration represents a priority for the Republic of Moldova on the way to state consolidation and European standards of governance implementation. The evaluation of accumulated experience, the study of international practices in the field, wording efficient solutions and training highly qualified staff is very important in the process of administrative reformation in the Republic of Moldova. Utilization of these suitabilities depend on the will and qualification of the teaching staff whose activity is aimed at adjustment of the science of Public Administration to the academic international standards. -
Prevenirea corupţiei în administraţia publică din Republica Moldova: analiză şi recomandări GRECO On May, 5 th, 1998 the Committee of Ministers at the Council of Europe instituted the GRECO (Group of States against Corruption) in the form of the partial and broad Agreement, aimed to respect twenty principle directions to attack the corruption, approved by the Resolution 97 (24) of the Committee of Ministers of the Council of Europe of November, 6 th, 1997, as well as, to apply other adequate international juridical instruments. -
Transparenţa administrativă: un element intrinsec al modernizării administraţiei publice The article aims at revealing some theoretical and practical arguments regarding the achievements of the public administration reform. In order to clearly define the mechanism for the modernization of public administration through the prism of administrative transparency, the author proposes that the Government of the Republic of Moldova elaborate a Multiannual Program for the Modernization of Public Administration, whose objectives shall foresee the master-mind and the promotion of actions for the modernization of the central and local public administration in the Republic of Moldova. -
Promovarea interesului naţional - misiunea administraţiei publice: tradiţii, relaţii şi perspective The national interest, as an active expression of the vital needs of the state that determines the formulation of the external policy and its relations with other states, has its own formation and promotion conditions and problems. Those connected with historical traditions, the national element and the receptivity potential, when influenced by the external factor, remain the determining ones. The author of the present article mentions that one of the characteristic peculiarities of the transition period from the command administrative system to the democratic one and the market economy is manifested not only through the politicization without precedent of the social life, through major difficulties in the process of formation, awareness and promotion of the national interest of the new independent states, but also through determining the place and the role of public administration in this process. -
Impactul "Noului Management Public" asupra administraţiei publice din Republica Moldova The complexity and multi-dimensionality of the necessary and opportune changes in public administration, in general, and in public management, in particular, stimulated the undertaking of an analysis regarding the impact of the “new public management” on the system of public administration from the Republic of Moldova. The topic on the statute of the science of administration is largely discussed in specialized literature. 1Ъе approaches of scientific researchers in this field are diverse. Public administration is characterized both as a domain of science and of art. Public administration is a science because it possesses: a) its own object of study: b) research method ;; c) the possibility to formulate principles. There exist preconceived ideas according to which the talent of a good organiser would be sufficient in the administrative activity and that the administrative activity is a purely executive one. -
Să tindem spre o ţară cu sistem profesional ierarhic contemporan în administraţia publică In the given article, the author examines not only the notions of ‘profession’, ‘professionalism’ and ‘professional culture’ but also makes concrete suggestions concerning the implementation of these phenomena in the activity of the central and local public administration bodies. At the same time, great attention is paid to the professional development of the public servants in the light of the recently adopted Law on Public Functions and the Status of the Public Servant. The author also analyzes the practice undertaken by other countries such as Belgium, Germany, Spain, France, and Luxemburg in the field of public servants’ professional development. -
Acces la informaţie transparenţă şi participare - dimensiuni-cheie în consolidarea instituţională a administraţiei publice The author of this article makes an analysis of both scientific reflection and information access monitoring, transparency and participation of citizens. In conclusion, the author mentions that, lately, monitoring and evaluation practices concerning some key dimensions of the public administration reform-access to information, transparency and public participation improved but still are inadequate. At the same time the author denotes the importance of simultaneous use of all these tools in the process of public administration reform, through which the indices of citizens' needs are in a direct proportion with the quality indices of public administration services provided. Making an analysis of the legal framework implementation referring the process of access to information, transparency and participation the author under-lines the following procedural distinctions: if the law on access to information gives citizens access to documents and information from a public institution, the law on transparency of the decision making process gives citizens access to draft normative acts and decisions of the administrative board. -
Inovaţiile - necesitate pentru eficientizarea activităţii administraţiei publice din Republica Moldova At the end of the XX and the beginning of the XXI centuries, the Republic of Moldova is undergoing a complicated and aching period of modifications. In this complicated period of crisis, the state needs to qualitatively reanimate the strategic-innovational function in order to revitalize the situation and to deter mine the administrative system. On the basis of performant indexes and interna tional standards, the prognosis, the programming and the planning of public administration tasks should prepare the ground for new ideas and innovations. The innovations in public administration should become a catalyst in order to obtain administrative efficiency. -
Eficienţa administratiei publice: criterii de apreciere şl factori de influenţă The Republic of Moldova undergoes a transitional period in its development. The Soviet system of public administration was destroyed by the end of the XX century and the carcass of a liberal-democratic system of public administration was built. For a long period of time, the system was filled with authoritarian bureaucratic mechanisms, dominant technologies and control activities. The tra dition of the past to solve the problems through the prism of ideology continued to remain the paradigm of the political thought of those in power. All these have delayed the implementation of the public administration reform. In these circum stances, the public institutions must approve and adapt to the realities and the challenges of the contemporary times. The process of governance should go beyond mere rules and institutions that contribute to managing change and in clude search methods establishing, implementing and assessing human develop ment policies at the highest level of consensus, success and impact. -

Cu privire la tendinţa administraţiei publice de a evolua în putere publică In the classic constitutional concept, the administration represents the real executive power based on the public power procedures. In this conception, the administration is not the only duty of the Executive, but it is an exclusive one. As an argument of sustaining this idea, it is shown that the Executive, through Government, has a multitude of extra administrative duties, provided in the constitutional relationships with the Parliament or in the international ones. In the meantime, the Administration is the exclusive duty of the Executive, because it could not be exercised by the judicial power, legislative power according to the separation of powers in the state. Contemporary political West European regimes’ observation shows that all these concepts can be found in the institutional practices, proving that the Administration can be tempted to become the center of a distinctive power from the one of the Government. The politicians’ power depends on the length of their political mandate, which is precarious by its nature, depending on the elector’s willing, while a high public function and the civil servants’ positions can be sure of their permanency. Due to this reason, the Administration could stop being a simple function in the existing conditions but it could become a real public administrative power distinct from the executive one. -
Elemente integrante ale conceptului de transparenţă administrativă în viziunea autorilor doctrinari The article contains the author’s vision on the characteristics of the concept of administrative transparency, which occupies an extremely important role in the organization and functioning of public administration. Its integral elements are also identified, starting from the essential vectors of a democratic society which tends to efficient governance. Thus, the concept of transparency becomes a priority aspect on the agenda of a more democratic and more efficient model of public administration activity. At present, the concept of transparency corresponds to contemporary principles of public administration and administrative law; it increases the motivation in the decision making process and citizens’ accessibility to administrative documents, develops security means within administrative procedures. It is defined in multiple ways, but it implies the same meanings: transparency is the key element in exercising the right to access to information; it is the key element to control, to check the public administration actions, to make possible institutional accountability through consulting and participation, which have as a positive impact the citizens’ increasing trust in authorities. As the same time, the author argues the idea that the right to access to information and participation in decision making are only two fundamental rights whose exercise is beneficial not only for citizens, but mostly, but also for the public administration, which should change from a controlled and close administration into an open, transparent and accountable one. -
Dimensiunea transparenţei administrative – oportunitate amplificată de dispozitivele comunicaţionale This paper is studying administrative transparency as an output of a long-term evolution and constant efforts to promote citizen best interest in the public affairs by ensuring and enforcing access to the information. Current changes in approaching administrative transparency’s concept are nothing but a reaction to the crisis of the authoritarian state as well as to the establishment of representative democracy, as well as to the necessity to reevaluate citizen’s role and position in the decision-making process in the Republic of Moldova. Furthermore, opinions stated in the present paper are mostly founded on the idea that currently, the dimensions of the administrative transparency are amplified by numerous communicative tools, dictated by the public administration reform in the Republic of Moldova. -

Probleme actuale ale controlului de legalitate al actelor autorităţilor administraţiei publice locale Moldova’s strategic vector is joining the European Union. This membership requires that Moldova has achieved stability of institutions guaranteeing democracy, the rule of law, human rights. An important objective of achieving European integration is to ensure the legality in all fields of the state, including local government, which will increase the administrative capacity of municipalities and districts. If Moldova is failing to strengthen administrative capacity, this fact will present an obstacle to the process of European integration. In the present agrticle, the author examines some theoretical and practical aspect of the legality of the control of the acts of local public administration. -

Conflictul de interese în administraţia publică This article addresses a particular type of conflict of interest in the civil service – the one resulting from contradictions between political orientation of a civil servant and his job duties. Such conflict emerges when the term in the office is used to promote interests of a certain political group. Causes of this type of conflict of interest are to be analyzed in the article, as well as the manners of expressing it in case of state dignitaries or career servants. Finally, political implications for the society are to be identified as well. -
Interferenţe între eficientizarea procesului decizional administrativ şi modernizarea administraţiei publice In this article, we are going to discuss about two processes, which are very important for public administration, with references to decision-making process, and modernization of public administration. We’ll study if between these two processes are any relations, and if they are, how these relations can affect any of these two processes. We’ll search if the process of modernization of public administration implies also the improvement of administrative decision-making process. In the same context, we’ll study how decision-making process can influence de process of modernization the public administration. -

Rolul autorităţilor administraţiei publice şi altor actori sociali în organizarea şi dezvoltarea serviciilor sociale pentru persoane în situaţii de dificultate This article is devoted to social services, which are tackled as a form of social assistance, as a result of the continous objectives of National Program on creating the integrated social system for 2008- 2013, the strategy of social inclusion of persons with disabilities. As a result of the ratification of the UN Convention on the Rights of Persons with Disabilities by Law nr. 166- XVIII of July 9, 2010, which has marked 5 years since its ratification, in the period from 5 to 10 July 2015, within the framework of International Scientific- practical conference on the topic ,,Five years after the ratification of the UN Convention on the Rights of Persons with Disabilities. Practical and Judicial aspects’ analysis.’’ At this time, the creation and development of new community social services is a ceaseless process, alternative institutionalized social services (residential) for children and adults, which are considered more efficient and less expensive for this system. They are meant to keep people or families in difficulty in an organizational propinquity to the community, having as a main objective the marginalization’s prevention, social ex¬clusion and facilitating the integration of beneficiaries in the family and community for improving their quality of life. The role of the organization, operation and development of social services reverts to: Ministry of Labor, Social Protection and Family and other Ministries, local public ad¬ministration authorities of level I and II, territorial structures of social assistance and their subdivisions with other social actors, associations, foundations, non-profit pri¬vate institutions, registered and accredited in accordance with the legislation in force, with the activity in the social sphere
