Conflictul de interese: Noţiune, conţinut, reglementare For the first time on the level of national legislation, conflict of interest has been reflected in Law on Con¬flict of Interest No.16 XVI of lb.02.2008. This study is aiminat the research of the notion, content and regu¬lation of a conflict of interest and at making proposals on the necessity of some changes in Law No. 16-XVI, regarding in particular the concept of personal interest and the extension of the list of related persons. It has been observed that the officials do not declare their interests, and the lack of Main Ethics Commission Hinders the implementation of a number of requirements of the legislative acts. -
Conflictul de interese în administraţia publică This article addresses a particular type of conflict of interest in the civil service – the one resulting from contradictions between political orientation of a civil servant and his job duties. Such conflict emerges when the term in the office is used to promote interests of a certain political group. Causes of this type of conflict of interest are to be analyzed in the article, as well as the manners of expressing it in case of state dignitaries or career servants. Finally, political implications for the society are to be identified as well. -
Aspecte privind reglementarea neutralităţii politice a funcţionarului public Această lucrare examinează integritatea și complexitatea reglementărilor legale privind neutralitatea politică a funcționarului public. În ceea ce privește incompatibilitățile/ interdicțiile, acestea se regăsesc în trei acte normative, lipsite de unele reglementări, precum neutralitatea politică și ar putea fi calificate ca vagi sau ambigue, datorită faptului că sunt deduse din principiile de conduită sau din noțiunea personală, interes pentru obligația de a declara conflictul de interese. Cadrul normativ în vigoare stabilește funcționarul public într-o zonă de incertitudine extinsă și asupra partidelor politice.
