Evoluţia viziunilor doctrinare privind conceptul de transparenţă Dans les conditions de l’йvolution contemporaine ou l’attention des organes de l’administration publique centrale et locale de la republique est dirigйe vers la rйalisation des taches primordiales de l’йtat de droit et dйmocratique, le role de la transparence administrative est toujours en plein essor comme moyen principal de gestion de l’йtat. Pour elucider l’йvolution de la vision doctrinaire visant la transparence administrative, l auteur precise le fait rue la transparence administrative, comme attribut de la gestion, prend sa source encore en antisuitй. On justifiй aussi l’idйe que la transparence administrative a les memes origines temporelles que l’йtat, puisque l’йtat est une structure oщ, indubitablement, la transparence a sa place particuliйre. En analysant le concept de la transparence administrative et l’йvolution des plus importantes visions doctrinaires concernant le systйme de la transparence, l’auteur constate que celle – ci a de racines plus anciennes que la science administrative. Au cours des periodes historiques, le phйnomиne de la transparence administrative eut de differentes importances mais il est certes que dans la periode contemporaine ou il existe la tendance vers un йtat de droit. -
Transparenţa administrativă: un element intrinsec al modernizării administraţiei publice The article aims at revealing some theoretical and practical arguments regarding the achievements of the public administration reform. In order to clearly define the mechanism for the modernization of public administration through the prism of administrative transparency, the author proposes that the Government of the Republic of Moldova elaborate a Multiannual Program for the Modernization of Public Administration, whose objectives shall foresee the master-mind and the promotion of actions for the modernization of the central and local public administration in the Republic of Moldova. -
Cadrul legal privind promovarea şi asigurarea principiului transparenţei The international experience demonstrates that citizens’ participation is an efficient instrument in influencing local development. Its advantages are manifested in the increase of the quality of the decision process, the consolidation of partnerships, the attraction of new funds and rational use of existent resources, the creation of a benefic image, and the increase of public administration authority. It is well-known that the transparency of public authorities and especially the continuous flux of information addressed to people is a precondition of efficient community participation. The lack of transparency in the administrative process and, implicitly, in the decision making one, represents one of the most serious obstacles in the creation of a democratic society. Citizens’ unlimited access to information of public interest and their participation in decision making. -
Promovarea transparenţei administrative prin asigurarea accesului la infrastructura informaţonală modernă In the present article, the author mentions that new possibilities of obtaining access to information in the field of public administration appeared at the end of the XX and the beginning of the XXI century. This fact is stipulated in both the national and the international legislations. Various electronic programs facilitate the direct contact of the citizen with the administrative bodies on the whole globe. Yet, it is worth mentioning that in order to get hold of the useful information and to conduct an efficient communication in the field of public administration, it is necessary to possess specific informational knowledge and linguistic culture. In this context, it is necessary to differentiate between the users of the information what concerns their skills and the informational strategies. -
Acces la informaţie transparenţă şi participare - dimensiuni-cheie în consolidarea instituţională a administraţiei publice The author of this article makes an analysis of both scientific reflection and information access monitoring, transparency and participation of citizens. In conclusion, the author mentions that, lately, monitoring and evaluation practices concerning some key dimensions of the public administration reform-access to information, transparency and public participation improved but still are inadequate. At the same time the author denotes the importance of simultaneous use of all these tools in the process of public administration reform, through which the indices of citizens' needs are in a direct proportion with the quality indices of public administration services provided. Making an analysis of the legal framework implementation referring the process of access to information, transparency and participation the author under-lines the following procedural distinctions: if the law on access to information gives citizens access to documents and information from a public institution, the law on transparency of the decision making process gives citizens access to draft normative acts and decisions of the administrative board. -
Concept şi determinări actuale ale transparenţei The approach of the concept of transparency in the light of the current vision imposes an analysis of the political and administrative system from the Republic of Moldova in the process of democratization. In this Paper, the author points to the fact that the finalization of the concept of transparency became an essential aspect on the agenda of the efficient leadership. The current visions on the characteristics of the concept of transparency are defined in different ways, but comprise the same sub layer: the instrument of a democratic model of public administration activity. As well, we conclude that transparence is the key element not just to control, check the actions of the public administration, but as well enables the institutional responsibility, that has as positive impact- the rise in the trust of the citizens to authorities. At the same time, the author concludes that the high number of definitions or the high number of elements included in the structure of definitions by the researchers of the European Institute of Public Administration, the International Institute of Administrative Science, similar institutions of national states (Romania, Moldova) is due to the large variety of modes of understanding (by theoreticians and practitioners) of the administrative transparency. This is explained via the fact that the activities on administrative transparence are developed in extremely different institutions and the methods and forms used imply objectives which are hardly conciliated. -
Cadrul legal privind promovarea şi asigurarea principiului transparenţei în Republica Moldova Transparency aims at ensuring greater access of citizens to information and documents in the possession of state institutions, citizen participation in decision making and ensuring the legitimacy, effectiveness and accountability of government to the citizen, The concept of transparency in the decision¬making process carried out in institutions is about ensuring citizens' access to documents in the management of state institutions and the public consultation on the adoption of regulations. Transparency, in the broad sense, refers to access to information of any kind, the possibility to choose any form. This paper aims at highlighting and reviewing procedures for transparency in government decision-making in Moldova. It also deals with ways of improving the relationship: public administration - citizens. We try to clarify the concept of transparency in the decisions and the methods by which they are transposed into concrete reality. -
Unele referinţe privind asigurarea accesului la informaţie şi transparenţei în procesul de administrare The application of the legal framework on administrative transparency in the Republic of Moldova, here we refer to the Law on access to information, including the transformation of the administrative culture into a democratic and transparent one, raises essential obstacles at present, especially for the countries with vulnerable economies, that have a limited budget for putting into practice a general program of additional measures. -
Elemente integrante ale conceptului de transparenţă administrativă în viziunea autorilor doctrinari The article contains the author’s vision on the characteristics of the concept of administrative transparency, which occupies an extremely important role in the organization and functioning of public administration. Its integral elements are also identified, starting from the essential vectors of a democratic society which tends to efficient governance. Thus, the concept of transparency becomes a priority aspect on the agenda of a more democratic and more efficient model of public administration activity. At present, the concept of transparency corresponds to contemporary principles of public administration and administrative law; it increases the motivation in the decision making process and citizens’ accessibility to administrative documents, develops security means within administrative procedures. It is defined in multiple ways, but it implies the same meanings: transparency is the key element in exercising the right to access to information; it is the key element to control, to check the public administration actions, to make possible institutional accountability through consulting and participation, which have as a positive impact the citizens’ increasing trust in authorities. As the same time, the author argues the idea that the right to access to information and participation in decision making are only two fundamental rights whose exercise is beneficial not only for citizens, but mostly, but also for the public administration, which should change from a controlled and close administration into an open, transparent and accountable one. -
Dimensiunea transparenţei administrative – oportunitate amplificată de dispozitivele comunicaţionale This paper is studying administrative transparency as an output of a long-term evolution and constant efforts to promote citizen best interest in the public affairs by ensuring and enforcing access to the information. Current changes in approaching administrative transparency’s concept are nothing but a reaction to the crisis of the authoritarian state as well as to the establishment of representative democracy, as well as to the necessity to reevaluate citizen’s role and position in the decision-making process in the Republic of Moldova. Furthermore, opinions stated in the present paper are mostly founded on the idea that currently, the dimensions of the administrative transparency are amplified by numerous communicative tools, dictated by the public administration reform in the Republic of Moldova. -

Implementarea Registrului de Stat al actelor locale - impact și provocări În acest articol este analizat unul dintre mecanismele legale de transparentizare a procesului decizional la nivel local. Înregistrarea și publicarea actelor emise/adoptate de către autoritățile administrației publice locale de nivelul întâi și al doilea a devenit o obligație, or nerespectarea acestor norme (încălcarea prevederilor Legii privind administrația publică locală) atrage după sine sancțiunea contravențională. -
Buna guvernare şi transparența în activitatea administrației publice Buna guvernare a devenit un sinonim al democrației și dezvoltării, în care statul de drept este baza esențială pentru prosperitate. Fiind fundamentată pe următoarele principii esențiale: transparența, participarea, eficacitatea și eficiența, incluziunea și responsabilitatea, buna guvernare a devenit un deziderat al cetățenilor și o realizare apreciată de către donatorii și partenerii externi. Prin urmare, pentru a întări principiile bunei guvernări, Republica Moldova a dezvoltat un cadru legal vast, încercând să-și respecte obligațiile asumate prin semnarea tratatelor și convențiilor europene și să satisfacă așteptările cetățenilor în combaterea corupției, promovarea transparenței și a valorilor participative. -
Aspecte teoretice privind conceptul de buna guvernare: caracteristici și dimensiuni O guvernare eficienta și în beneficiul cetațeanului nu poate fi realizata fara asigurarea implementarii principiilor guvernarii deschise. Crearea unei administrații publice moderne, profesioniste, orientata spre furnizarea de servicii publice de calitate, presupune în mod direct asigurarea comunicarii permanente cu societatea, integritatea, funcționarii publici onești și responsabili, precum și înlaturarea tuturor barierelor administrative și birocratice dintre sectorul public și cetațeni. Un guvern deschis contribuie la bunastarea sociala și economica a țarii și se bucura de încrederea cetațenilor.
